Terms of Use

1. What ZolMarket is

ZolMarket is an online classifieds platform. Users post advertisements to sell, rent or exchange items, vehicles, property and services, and other users contact them directly.

ZolMarket is only a venue. We are not the seller, buyer, agent, broker or auctioneer of any item, and we are not a party to any agreement between users. We do not take possession of items, handle delivery, hold money on behalf of users, or guarantee that a transaction will be completed. Any deal you make is solely between you and the other user.

2. Who can use the Service

• You must be at least 18 years old and legally able to enter into a binding agreement.
• You must not have been previously banned from the Service.
• You must use the Service in line with the laws that apply to you.

You can browse ads without an account. Posting ads, chatting, saving favourites, following sellers and leaving reviews require an account.

3. Your account

• Give accurate information when you register and keep it up to date.
• Keep your password confidential. You are responsible for everything done through your account.
• One person, one account. Do not create accounts to get around a ban or a posting limit.
• Do not impersonate another person or business.
• Tell us straight away at support@zolmarket.com if you suspect unauthorised use of your account.

4. Posting ads

When you post an ad you confirm that:

• you own the item or are authorised to offer it, and it is legal to sell, rent or exchange it;
• the title, description, price, condition, location and photos are accurate, complete and not misleading;
• the photos show the actual item and you have the right to use them;
• the ad is placed in the correct category and is not a duplicate of another active ad of yours;
• you will not leave an ad active once the item is no longer available.

Ads may be reviewed before and after they are published. We may edit the category of an ad, refuse it, or remove it at any time if we believe it breaks these Terms or our Safety & Rules.

5. Prohibited items and content

You must not list, offer or request any of the following:

• illegal drugs, drug paraphernalia, and prescription-only medicines;
• firearms, ammunition, explosives and other weapons;
• stolen goods, or goods you have no right to sell;
• counterfeit, replica or pirated goods, and anything that infringes intellectual-property rights;
• alcohol, tobacco and vaping products where their sale is restricted by law;
• human beings, human organs or body parts, and any form of human trafficking or forced labour;
• endangered or protected animals and plants, and products made from them;
• sexual services, pornography and any sexually explicit material;
• any content that sexualises or endangers children;
• identity documents, government-issued documents, bank accounts, SIM cards registered to another person, and personal data;
• counterfeit currency, pyramid or “get rich quick” schemes, and unlicensed financial services;
• hazardous, recalled or unsafe goods;
• anything else that is illegal where you or the buyer are located.

6. Prohibited behaviour

You must not:

• defraud, deceive or mislead other users, or ask for advance payment with no intention of delivering;
• harass, threaten, insult or discriminate against anyone, or post hateful or violent content;
• send spam or unsolicited advertising, or use chat for anything unrelated to an ad;
• post false reviews, or manipulate ratings, views or followers;
• collect other users’ information, or use it for any purpose other than completing a transaction with them;
• copy, scrape or bulk-download content from the Service, or use bots or automated tools to access it;
• upload viruses or malicious code, probe or disrupt the Service, or try to bypass security or moderation;
• reverse-engineer the app, except where the law expressly allows it.

7. Dealing with other users

You are solely responsible for your interactions with other users. We do not verify the identity of users or the quality, safety, legality or description of the items they advertise. Inspect items before paying, meet in a safe public place, and never send money in advance to someone you have not met. More guidance is on our Safety & Rules page.

If you have a dispute with another user, you must resolve it with them directly. We may, but are not obliged to, help by acting on reports.

8. Reporting, blocking and moderation

You can report any ad or user from inside the app, and you can block a user so that they can no longer message you. We review reports and may remove content, restrict features, or suspend or permanently ban an account, with or without notice, when we believe these Terms have been broken or when it is needed to protect users or the Service. If you think we made a mistake, contact support@zolmarket.com.

9. Fees and paid services

Creating an account, browsing and posting standard ads are currently free. We may introduce optional paid services, such as featured or promoted ads. Prices and what is included will be shown clearly before you pay, payments will be handled by third-party payment providers, and unless the law requires otherwise or we state otherwise at the time of purchase, fees for a service that has already started are non-refundable. If an ad is removed because it broke these Terms, any fee paid for promoting it is not refunded.

10. Advertising

The Service is supported by third-party advertisements. We are not responsible for the content of those advertisements or for the products or services they promote.

11. Your content

You keep ownership of the text, photos and other material you post (“your content”). By posting it, you give ZolMarket a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for example resize or translate) and distribute your content for the purpose of operating, promoting and improving the Service. This licence ends when your content is deleted from the Service, except for copies kept in routine backups for a limited time and content already shared with other users, such as messages you sent them.

You confirm that you have all the rights needed to grant this licence and that your content does not infringe anyone else’s rights.

12. Our intellectual property

The ZolMarket name, logo, app, website, design and software belong to ZolMarket or its licensors. We grant you a personal, limited, non-transferable, revocable licence to use the app and website for their intended purpose. You may not use our name or logo without our written permission.

13. Copyright and trademark complaints

If you believe content on the Service infringes your intellectual-property rights, email legal@zolmarket.com with: a description of the work or mark, a link to the ad or profile, your contact details, and a statement that you are the rights owner or authorised to act for them. We will review the complaint and remove content where appropriate.

14. Ending your use of the Service

You can stop using the Service and delete your account at any time — see Delete Account. We may suspend or close your account if you break these Terms, if we are required to by law, or if your account creates risk for other users or for us. Sections that by their nature should continue after your account ends (including sections 11 to 13 and 15 to 18) will continue to apply.

15. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, about the Service or about any item, ad or user, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted, secure or error-free, or that ads are genuine or accurate.

16. Limitation of liability

To the fullest extent permitted by law, ZolMarket and its owners, staff and partners are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, data or goodwill, arising from your use of the Service, or for any loss or damage arising from a transaction, communication or meeting between users. Where our liability cannot be excluded, it is limited to the greater of the total fees you paid to ZolMarket in the 12 months before the claim and the equivalent of USD 50. Nothing in these Terms excludes liability that cannot be excluded by law.

17. Indemnity

You agree to compensate ZolMarket for any claims, losses and reasonable costs that arise from your content, your ads, your dealings with other users, or your breach of these Terms or of any law.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of the Sudan. Please contact us first at legal@zolmarket.com so that we can try to resolve any dispute informally. If we cannot, the dispute will be submitted to the competent courts of the Republic of the Sudan, unless the consumer-protection law of your country of residence gives you the right to bring a claim in your local courts.

19. Changes to the Service and to these Terms

We may add, change or remove features at any time. We may also update these Terms; when we do we will change the “Last updated” date above and, for significant changes, notify you in the app or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.

20. General

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganisation or sale of the business. These Terms, together with the Privacy Policy and Safety & Rules, are the entire agreement between you and ZolMarket about the Service.
